In Mapp v. Ohio (1961) the Supreme Court decided that:
  1. Defendants have a right to legal counsel.
  2. Police may search a vehicle if they have probable cause of criminal activity.
  3. Evidence of a crime found through an unlawful search may not be admitted in court.
  4. Police must inform defendants of their rights when they are arrested.
  5. All property in a marriage is jointly owned.
Answer: C - In Mapp the Court found that evidence could not be used in trial unless it had been “lawfully obtained.” Lawful attainment generally means through a search warrant as stated in the Fourth Amendment, but there are some “probably cause” exceptions such as illegal materials sitting in plain sight of a police officer. After Mapp, police departments around the country started being a lot more careful in gathering evidence.
