Answer: C -FDR’s “Court Packing Plan”- in which he tried to appoint additional justices to the U.S. Supreme Court, beyond the nine required by the Constitution-was considered by many to be an attempt to subvert the separation of powers. While the government has the right to change Constitutional law, the legislative branch is generally responsible for enacting new laws, particularly when it concerns expanding the president’s power to appoint additional people to government office. Roosevelt’s bill was defeated handily, and the incident is a rare blemish on a presidential record that is otherwise considered one of the best in history.
